These Terms & Conditions (“Terms”) govern the provision of commercial photography services (“Services”) by Pixel-media.in (“we,” “our,” or “us”) to clients (“you” or “your”). By booking our Services or using our website, you agree to these Terms.
2. Services Provided
We offer commercial/product photography services for businesses. All details (such as type of photography, number of images, shoot locations, and timelines) will be agreed upon in writing before the shoot.
3. Booking & Payment
- A written quotation or proposal will be provided for every assignment.
- A non-refundable booking fee may be required to secure your shoot date.
- Final payment is due upon delivery of images unless otherwise agreed in writing.
- Prices may vary based on location, complexity, and additional requirements.
4. Cancellations & Rescheduling
- Cancellations made at least 10 days before the shoot date may receive a partial refund (excluding the booking fee).
- We reserve the right to charge additional fees for last-minute rescheduling or cancellations.
5. Delivery of Images
- Edited images will be delivered in digital format (unless otherwise specified) within 30 business days after the shoot.
- We retain the right to select the best images from the shoot for delivery.
- Raw or unedited files are not provided unless agreed upon in writing.
6. Usage Rights & Copyright
- We retain full copyright to all images created unless transferred by written agreement.
- Upon full payment, you are granted a non-exclusive commercial license to use the images for your business marketing and promotional purposes.
- Images may not be resold, altered beyond agreed edits, or transferred to third parties without our written consent.
7. Our Rights to Use Images
Unless otherwise agreed, we may use selected images for our portfolio, website, social media, and promotional purposes. If you prefer confidentiality, please request it in writing before the shoot.
8. Client Responsibilities
- Ensure all necessary permissions, product samples, and locations are available at the scheduled time.
- Ensure that any persons featured have provided consent if required.
- Provide clear instructions and expectations in advance to avoid delays or additional fees.
9. Limitation of Liability
While we take utmost care in handling your products and delivering high-quality images, we are not liable for any indirect, incidental, or consequential damages. Our liability is limited to the amount paid for the Services.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Delhi, India. Any disputes will be subject to the exclusive jurisdiction of the courts in Delhi
11. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on our website and take effect immediately.
